Commissioner McCreevy calls for action in the development of the European patent system - 08.09.2006

In the Conference IPR at the Crossroads (September 6-8) leading specialists tried to find solutions to the knots of the industrial property policy, particularly the patent system. The Conference was organised by the Ministry of Trade and Industry of Finland, the National Board of Patents and Registration of Finland, the Technology Industries of Finland Centennial Foundation and IPR University Center (University of Helsinki) in co-operation with the European Commission.

The speakers represented policy makers, academia and industry as well as patent offices. Most presentations will be published on the web site of IPR University Center on week 37 / 2006.

Charlie McCreevy, the European Commissioner for Internal Market and Services reminded the audience of the success story of the Community Trade Mark. The situation with patents is more difficult. The Community Patent is not yet a reality and the s.c. Munich system is incomplete as it lacks a unified judicial system.

Referring to the results of the recent consultation of the Commission on the future of patent policy in Europe, Mr McCreevy suggested a two pronged approach: fresh ideas to advance the Community Patent and involving the Community in the EPLA (European Patent Litigation Agreement) negotiations. There is a desire for a patent system which is simpler, more cost-effective but still of high quality. He reminded that industry wants is a genuine “one-stop-shop”.

The Finnish Minister of Trade and Industry, Mauri Pekkarinen, said that the Finnish Presidency seeks to broaden the innovation policy perspective. According to him, the most cost-effective solution to the the Community patent languange problem would probably be based on a “one-language-only” approach, The best solution, however, is not always politically feasible, he added.
